1787, Sep 17 - Land: John Towson to John Elder, Adams Garden

John Towson to John Elder

This Indenture made this Seventeenth day of September One Thousand Seven Hundred and Eighty seven Between John Towson of Baltimore County farmer of the one part and John Elder of the County aforesaid farmer of the other part witnesseth that the said John Towson for and in Consideration of the sum of Three Hundred pounds Current Money of the State of Maryland to him in hand paid by him the said John Elder the Receipt whereof the said John Towson doth hereby Acknowledge and therewith fully Contented Satisfied and paid and doth hereby Aquit Exonerate and discharge the said John Elder his Heirs Executors Administrators and Assigns hath given granted aliened Bargained sold Enfeoffed & Confirmed and by these presents doth give grant alien Bargain sell Enfeoff and Confirm unto him the said John Elder his Heirs and assigns all that parcel of Land being part of a Tract of Land Called Adams Garden laying on the Branches on the falls of Patapsco River Beginning at two Bounded White Oaks near to a marsh and on the East Side of a Branch leading into the Piney Falls standing at the end of one of the Divisionall Lines of part of the aforesaid Adams Garden Sold by Adam Shipley to John Elder and running

thence South Eleven degrees East Ninety three perches

then South Seventy nine degrees west Sixty two perches

then North forty five degrees West one Hundred and ninety two perches to intersect the forty ninth Course of the whole Tract

thence with the Original Lines North Eleven degrees East Twenty three perches to the end of the said Course still with the Original lines

North forty two degrees East Thirty two perches

then North Sixty five degrees East forty perches

then South forty two degrees East one Hundred and fifty four perches

then with a Straight line to the first Begining

Containing and laid out for One Hundred and One Acres of Land be the same more or Less To Hold the aforesaid part of a Tract of Land Called Adams Garden Together with all houses fences & woods and Meadoes on the said Land thereunto belonging unto him the said John Elder his Heirs and assigns forever and the said John Towson doth Covenant and agree to and with the said John Elder his Heirs and Assigns to have the aforementioned Land and premises with all and every the Appurtenances thereunto belonging to the same in any wise appertaining and the said John Towson doth further for himself his Heirs Executors Administrators and Assigns doth Covenant and agree to and with the John Elder his Heirs and assigns that he the said John Towson his Heirs and Executors and Administrators shall and will warrant and forever defend the aforesaid Land and premises unto him the said John Elder his Heirs and assigns against him the said John Townson his Heirs and assigns Claiming from by or under him or them.

The words Called Adam Garden Between the ninth and tenth line from the top Interlined beford signd.

Received of John Elder the Sum of three Hundred pounds Currency which being the Consideration Money for the within land and premises as witness my Hand this 7th day of September One Thousand Seven Hundred and Eighty seven.

Testes - Geo. Goulds Presbury

Septr 7th One Thousand Seven Hundred and Eighty seven then came before us two of the Justices for Baltimore County in the State of Maryland the within John Towson and acknowledged the within Indenture to be his Act and Deed and the Lands and premises therein mentioned to be the right and Estate of the within named John Elder his Heirs and assigns forever at the same time came Penelope wife of the aforesaid John Towson who being privately examined out of the hearing of her Husband fully acknowledged that she gave up all her right and Title of Dower unto him the said John Elder without any Treats or fear of the displeasure of her Husband According to the true intent and meaning of these presents.
