1835, Aug - Deed: Robert Alexander to Samuel Tanner, 243 acres on Spring Creek

Excerpt from Jackson County, WV, Deed Book 3, Page 271:

R. Alexr. to Saml. Tanner

This Indenture made concluded and agreed upon this 10th day of August A. D. One Thousand Eight hundred and thirty five Between Robert Alexander of Woodford County State of Kentucky of the first part and Samuel Tanner of the County of Jackson State of Virginia of the second part Witnesseth that the said Robert Alexander sole devisee of John Savary deceased for an in consideration of two hundred and forty three dollars to him in hand paid by Samuel Tanner a party of the second part the receipt whereof is hereby acknowledged hath granted bargained sold confirmed conveyed and assigned and by these presents do grant bargain sell confirm convey and assign to the said Samuel Tanner his heirs and assigns a certain tract of Land containing two hundred and forty three acres more or less lying in the aforesaid county of Jackson on the waters of Spring Creek a branch of little Kanawha being part of a survey made for Albert Gallatin the twentieth day of October 1783 patented to him the 26th day of August 1788 containing six thousand acres of which fifteen hundred acres were sold (by John Savary and surveyed the tenth day of February 1810 to Sequinio de Korblay the remainder being four thousand five hundred acres remained the property of said Savary who devised the same and all his other property to said Alexander as will more fully appear by his last will and Testament duly proven and admitted of record in the county court of Bourbon county Kentucky and recorded in the clerks office of Jackson County Virginia which tract is butted and bounded as followeth (to wit)

Beginning at a white oak standing near the head of a small drain on south side of hill corner to No. 1

Thence with a line of the same N 61 E 32 chains to small hickory on the top of ridge corner to No. 2

Thence with a line of the same S 40 E striking the creek and running along the Easterly bank 25 chains to two Sycamores

thence up the creek with its meanders and binding thereon adjoining No. 2 & 4 and the land sold to Henry Runnion to a black oak and Lynn corner to the latter standing on the east side of the creek in a short bend

thence with another of his lines S 62 W 3 chains 30 links to a sugar tree standing on the south side of Bend run

thence N 15 W 62 chains to the place of the beginning containing as above 243 acres and is called in the plat of said surveyor by Number three

Together with all the apertanances thereunto belonging or in any wise appertaining. To have and to hold the aforesaid premises unto the said Samuel Tanner his hers and assigns for ever and the said Robert Alexander for himself his heirs Executor and administrators do covenant to and agree with the said Samuel Tanner his heirs Executors and adminstrators that he will and his heirs shall warrant and defend the said tract of Land to him or them against the Lawful claims of any persons claiming the same by or threw him and his heirs and assigns and throu Savary and Gallatin for ever.

The Testimony whereof the said Alexander party of the first part by John Peter Romain Bureau his attorney in fact they by him for that and other purposes appointed hath hereto set his signature and seal they day and year first above written.

State of Ohio Gallia County (to wit)

We Franklin Carrell and John Cating two justices of the peace for & within the said County of Gallia do hereby certify that John P. R. Bureau attorney in fact for Robert Alexander the first party to the forgoing deed bearing date the Tenth day of August one thousand Eight hundred thirty five Personally appeared before us in our said County and acknowledged the same to be his act and deed as attorney as above said and desired us to certify the said acknowledgement to the clerk of the County Court of Jackson Virginia in order that the said deed May be recorded.

Given under our hands and seals this 19th day of September A. D. 1835.

This day the foregoing deed from Robert Alexander by John P. R. Bureau his attorney in fact to Samuel Tanner together with the certificate of acknowledgement thereto annexed was admitted to record.
