1835, Jul 21 - Deed: Robert Alexander to John Greathouse, 425 acres on Spring Creek

Excerpt from Wirt County, VA, Deed Book 1, Page 59-60:

This Indenture made concluded and agreed upon this twenty first day of July in the year of our Lord one thousand eight hundred and thirty five. Between Robert Alexander of Woodford County State of Kentucky of the first part and John Greathouse of the County of Jackson State of Virginia of the Second part: Witnesseth that the said Robert Alexander being sole devisee of John Savary, deceased for and in consideration of Two hundred and fifty dollars to him in hand paid by the said John Greathouse party of the second part, the receipt whereof is hereby acknowledged hath granted, bargained, Sold and confirmed, conveyed and assigned and by these presents grant, bargain, sell, confirm convey and assign to the said John Greathouse, his heirs and assigns a certain tract of land containing four hundred and twenty five (425) acres, more or less lying in the aforesaid County of Jackson on the waters of Spring Creek, a branch of Little Kanawha, being part of a survey made for Albert Gallatin the 20th day of October 1785, patented to him the twenty sixth day of August 1788, containing in the which six thousand acres from which fifteen hundred acres were sold by John Savary to Sequinio D. Korblay and surveyed by Reuben Slaughter the 10th day of February 1810 and the remainder four thousand five hundred acres became the property of said Savary by a deed of partition between him and Albert Gallatin and remained his until his death. Thence the property of said Robert Alexander as Sole devisee of Said Savary, all which will more fully appear in reference to the records of the Clerks office which tract of land is butted and bounded as follows to wit.

Begining at a Sugar tree made as the most northerly corner of the Six thousand acre Survey, standing on the lower side of a drain, back of the upper end of William Boggs meadow,

thence along the easterly line of the whole survey S 8 [deg.] 30" E & 48 chains to a pile of Stones on the west Side of a hill, on the east Side of Devils hole corner to Number two,

thence with a line of Same S 82 W 23 chains to an Elm and Box elder [maple] on the Easterdly bank of the Creek thence S 61 [degrees] W alang the bank of the creek and crossing the same Sixty five chains to a White Oak corner to No. 3

thence N 30 W 51 chains 50 links to a white oak by a drain of Rock Camp and near the head in the northerly line of the whole Survey,

thence with the Same N 68 [degrees] 30 minutes E 106 chains to the place of begining

agreeably to a Survey thereof made by Nathan Smith Esquire Surveyor of Mason County, the 27th October 1834 and denominated by No. 1 on his plot, together with all the appurtenances thereunto belonging or in any wise appertaining.

To Have and To Hold the aforesaid premises unto the Said John Greathouse, his heirs and assigns forever. And the said Robert Alexander for himself, his heirs executors and administrators do covenant to, and agree with the said John Greathouse, his heirs, executors and administrators that he will and his heirs shall warrant and defend the said tract of land to him or them against the lawful claim or claims of any person or persons claiming the same by or throu him and, his heirs and assigns, and throu Savary and Gallatin for ever. In Testimony whereof the Said Alexander party of the first part by John Peter Romain Bureau his attorney in fact by him Said Alexander for that and other purposes appointed hath hereto Set his Signature and Seal, the day and year first above written.

State of Ohio Gallia County:

We Franklin Carel and John Cating two justices of the peace for and within the said County of Gallia do hereby certify that John P. R. Bureau attorney in fact for Robert Alexander the first party to the foregoing deed bearing date July the 21st one thousand eight hundred and thirty five, personally appeared before us in the said County, and acknowledged the same to be his act and deed as attorney in fact before said and delivered us to certify the said acknowledgement to the Clerk of the County Court of Jackson Virginia in order that the said deed may be recorded.

Given under our hands and seals this 19th day of September A D 1835.

I Daniel Wilkinson Clerk of the County Court of Wirt County do hereby certify that the forgoing is a true copy of a deed of bargain and sale from Robert Alexander by his attorney in fact J. P. R. Bureau to John Greathouse together with the certificate of acknowledgement thereto annexed and that the same was received by me in my office for the purpose of being Recorded on the 12th day of April 1849 and admitted to record on the same day.
